Procedure:
In accordance with Section 39 of the Redundancy Payments Acts 1967 - 2014 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background
The claimant was employed by the respondent from November 2012 until the 19th April 2017. She earned €340 gross per week. The claimant submitted a letter she had received from the respondent “stating she was no longer in the employment of the respondent as they had ceased trading and there is no longer any employment available”.
The claimant was paid her notice, however she did not receive any redundancy payments
Findings
The respondent did not attend.
I find that based on the respondent’s letter dated the 19th April 2017 the claimant was made redundant.
Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I decide in relation to the complaint in accordance with the relevant redress provisions under that Act.
I find that the claimant is entitled redundancy payment for the period of her service from November 2012 to the 19th April 2017 where she was paid €340 gross per week working 20 hours @ €17per hour.
